What happens to the Intellectual Property of an individual after the individual dies Can intellectual property Rights be inherited? Yes it can.
For the sake of this post, I'll divide Intellectual Property into 2parts: Registerable & Non-Registerable Intellectual Property Rights
Registerable Intellectual Property are the ones that demand registration for its protection e.g Trademark, Industrial Design & Patent while Non-Registerable Intellectual Property are vice versa e.g. Copyright
Upon the death of the individual, the intellectual property rights are supposed to rest on the estate of the individual but this can be controlled and made easy by including it in the will.
The remaining years of IP protection could be transferred to anyone that the individual wishes to and the person becomes the owner of the IP till the duration elapses & the work goes back to public domain. And for registerable IP, the person who inherited the IP can decide to renew it. @izzyodigie asked me a similar question during our last IG live session. Issues may arise as to the ownership of the IP upon the death of the individual but this can be easily managed by including it in the will or creating a trust around it. Plus intellectual property worth increases upon death of the individual so it could be a real money maker for the estate or whoever inherits the Intellectual Property.
As a creator, its important to include your Intellectual Property as part of the properties to be transfered through your will.
